Company Consultants (by Company Partners) Terms and Conditions of Facilitation Service

Introduction & Independent B2B Status
Welcome to Company Consultants, a specialised division of Company Partners (Pty) Ltd (Registration Number 2015/082857/07). By accessing our websites or user systems (including companyconsultants.co.za and all associated network sites), you agree to these Terms and Conditions.
Important Independence & Transparency Notice: As a premium, independent B2B consultancy, we are a private entity and are NOT affiliated with, nor do we represent, the South African Government, the CIPC, SARS, COIDA, CIDB, PSIRA, the NHBRC, or any other state department. We offer private facilitation and meticulous administrative application preparation services to streamline your corporate compliance requirements.
User Account Creation & Security
To engage our professional facilitation services, you must be 18 years or older and create a user account. You are solely responsible for maintaining the confidentiality of your username and password. You agree to notify us immediately of any unauthorised account use. You will be held liable for any facilitation service requests initiated under your account prior to such notification.
Payments & Private Service Pricing
All pricing is 100% transparent and available on our website. We accept secure payments via Credit Card, Direct EFT, Direct Bank Deposit (FNB, ABSA, Standard Bank, Nedbank), Cash/Debit at approved payment partners, and Mobicred. For EFT/Direct deposits, payment must be made within 5 days of requesting our facilitation, and proof of payment emailed to us. Our private consulting fees are clearly separated from standard mandatory statutory costs.
Cancellations, Facilitation Service Revisions & Refunds Policy
We operate with absolute financial integrity in accordance with the Consumer Protection Act (CPA), where applicable to qualifying consumers:
Incomplete Facilitation Services: If a facilitated service is incomplete or fails to meet our professional standards within 6 months of commencement, you may request a correction, re-execution, or refund without penalty.
Change of Mind & Work Commenced: If you cancel an agreement, Company Partners reserves the right to allocate refunds as System Credit. If work has already commenced on your requested facilitation service, we reserve the right to withhold a cancellation fee of 25% - 50% of the total invoice (with a minimum of R250 if cancelled within 6 months, and R500 if cancelled within 24 months) to cover operational costs incurred.
Refund Administration Time: Approved refunds will be administered within 30 days of receiving the required FICA compliance documentation and standard identity verification paperwork.
Facilitation Service-Specific Terms
Private Shelf Company Facilitation: Quotations are valid for 5 working days. New Director details must be provided to our firm for independent CIPC update facilitation within 9 months of securing the private Shelf Company transfer. If no amendments are made within this period, we reserve the right to withdraw the private Shelf Company from our inventory without compensation to facilitate the administrative updating of statutory returns and cover incurred costs.
B-BBEE Affidavit Facilitation: By submitting the B-BBEE compliance questionnaire, you warrant that your provided financial turnover information is accurate and that you meet the statutory requirements for an EME B-BBEE Affidavit declaration preparation. You bear full legal responsibility for the accuracy of this information.
Third-Party & Offshore Consulting Services: We utilise specialised, legally qualified third parties for POPIA compliance administration and offshore structuring. Company Partners acts only as a facilitator and does not provide legal or tax compliance advisory services. You are subject to the third party's specific terms, and Company Partners holds no liability for non-compliance or tax liabilities arising from these structures.
Delivery of Facilitation Services
We endeavour to deliver our facilitation services via electronic data message (email) or secure electronic delivery within 30 days of receiving cleared payment and all necessary supporting information from you. If a delay occurs due to statutory body processing timelines or third-party service providers, we will notify you immediately.
Promotions, Vouchers & Service Bundle Deals
Gift vouchers are valid for 3 years from the date of generation and are not redeemable for cash. Discount coupons are provided at our discretion, can generally be used once per facilitation service request, and cannot be applied retroactively. If you purchase a discounted "Compliance Bundle Deal" and later cancel a component of that bundle, refunds will be calculated based on the actual discounted facilitation price, not the normal standalone price.
Privacy & POPIA Compliance Administration
We respect your privacy and manage personal information strictly in accordance with the Protection of Personal Information Act (POPIA).
We collect data (applicant name, identity verification details, company administrative details) solely to complete required statutory compliance administration, render facilitation services, and meet legal retention obligations.
We will never distribute or transfer your data to unauthorised third parties.
We implement strict technical measures to prevent data breaches; however, we cannot be held liable for unauthorised disclosures outside our direct control unless due to gross negligence.
By using our professional services, you consent to receive electronic communications. You may opt out of promotional marketing at any time.
Platform Intellectual Property, Indemnity & Limitation of Liability
All website content, trademarks, logos, and digital systems are the exclusive property of Company Partners. You may not copy, reproduce, or distribute any part of our platform without prior written consent. You agree to indemnify Company Partners against any third-party claims arising from your unauthorised use of our facilitation services. You use our website and consulting services entirely at your own risk. To the maximum extent permitted by law, Company Partners, its directors, and employees shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our platform, delays in statutory body processing timelines, or reliance on information provided. We do not warrant that our website is free of viruses or destructive code.
Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. By using our independent services, you consent to the exclusive jurisdiction of the High Court of South Africa (Western Cape Division, Cape Town) for any disputes arising from this agreement.
